The Space App — Seller Agreement (Updated)

Update Summary:
This update adds explicit tax responsibilities, sanctions/AML screening, regulated-category compliance, and security obligations.

1. Taxes & Invoicing​

  • Sellers are solely responsible for compliance with tax laws in their respective jurisdictions, including:

    • Accurate classification of products or services,
    • Calculation and collection of applicable taxes,
    • Generation and delivery of valid tax invoices to Buyers.

  • In jurisdictions where Kspace is classified as a Marketplace Facilitator, we may:

    • Collect and remit certain taxes on your behalf,
    • Provide necessary tax reporting as required by law.

2. Sanctions & Anti-Money Laundering (AML)​

  • You agree to:

    • Undergo Know Your Customer (KYC) screening,
    • Allow us to perform sanctions checks as required by applicable laws.

  • Activities deemed high-risk may result in:

    • Withheld payouts,
    • Temporary suspension of your seller account,
    • Further review or permanent deactivation.

  • Prohibited activities include:

    • Sales to or on behalf of individuals, organizations, or regions subject to international sanctions.
    • Any transaction that violates export/import control laws or embargo regulations.

3. Regulated Categories​

  • If you sell products in regulated categories, you must:

    • Provide valid compliance documentation (e.g., CE, FCC, UL, MSDS) as required by jurisdiction.
    • Submit such documentation before listing or upon request.

  • In the event of a recall or safety notice:

    • You are required to take immediate action,
    • Notify affected Buyers using available tools on the Platform.

4. Security & Data Handling​

  • You must:

    • Enable Two-Factor Authentication (2FA) for your account,
    • Use Buyer data only for order fulfillment and support,
    • Delete or anonymize Buyer data after use unless required to retain it by law.

  • Platform data and system access:

    • API keys must be protected and used only with approved integrations,
    • Unauthorized scraping, exporting, or duplication of Platform data is strictly prohibited.

By continuing to use The Space App, you acknowledge and agree to comply with this Seller Agreement and any future updates.
